Who needs to renew their digital nomad visa?
This procedure is required for individuals who have completed their first year of residence in Spain under a Digital Nomad Visa or after three years if the visa was initially issued in Spain. This applies to both self-employed individuals and remote workers with an international contract.
Renewing the digital nomad visa in Spain is not automatic; it requires a formal application, including proof of compliance with all legal, tax, and administrative requirements to maintain your permit.
Before starting the renewal process, it is essential to ensure that you still meet the core requirements of the [Digital Nomad Visa in Spain] that allowed you to obtain residency in the first place.
Duration and renewal timeline
The initial length of the digital nomad visa in Spain depends on where it was issued:
- If processed through a Spanish Consulate in the applicant’s country of origin, the visa is valid for 1 year, after which a residence permit can be requested for up to 3 additional years.
- If applied for directly in Spain through the UGE (Large Companies Unit), an initial 3-year permit is granted.
After this period, you may apply to renew your digital nomad visa in Spain for an additional 2 years, provided you continue to meet the requirements outlined in Law 28/2022, which promotes the ecosystem of emerging companies (commonly known as the Startups Law).
Renewal & Long-Term Residency:
Upon completing five continuous years of legal residence in Spain, you become eligible for Permanent Residency (under Law 14/2013, as amended). This status provides significant advantages:
- Indefinite Stay: The right to live and work in Spain indefinitely.
- Equal Rights: You will enjoy the same professional and social benefits as EU citizens.
- Flexibility: Your residency is no longer tied strictly to the specific requirements of the Digital Nomad Visa.
Why You Should Start Your Renewal 60 Days Before Expiry
At Tejada Solicitors, we recommend starting your Digital Nomad Visa renewal during the 60 days before your residence authorisation expires. Applying early provides valuable time to respond to unexpected issues and, where legally possible, preserve the option of submitting a new application if the first one is closed or refused.
The UGE may request additional evidence when documents are missing or when compliance is not sufficiently demonstrated. These requests normally impose a strict deadline of 10 working days. Failure to provide the correct documents within that period may result in the application being treated as withdrawn or refused.
In practice, the UGE’s documentary requirements and assessment criteria can evolve, and new expectations may not always be immediately reflected in public guidance. Recent decisions also show particularly close scrutiny of applicants’ compliance with their Spanish tax and Social Security obligations.
For example, our firm recently handled the renewal of a self-employed UK national whom we had advised in 2023 to register with both the Spanish Tax Agency and Social Security. The applicant did not complete those registrations until May 2024. During the renewal, the UGE required evidence that her tax and self-employed status had been fully regularised. This resulted in additional tax liabilities, late-registration costs and penalties that could have been reduced or avoided with earlier compliance.
At Tejada Solicitors, our immigration lawyers and international tax advisers review each renewal together. This coordinated approach allows us to identify potential compliance problems before submission, prepare the required evidence and reduce the risk of delays, additional costs or refusal.
Requirements to renew your visa
It is essential to be thoroughly familiar with all requirements for renewing the digital nomad visa, as any error in documentation can result in the UGE (Large Companies Unit) denying your renewal, thereby losing all associated benefits.
